Tesla (TSLA, Financials) CEO Elon Musk filed for a preliminary injunction against OpenAI to prevent it from being for-profit.

The lawsuit claims that OpenAI and Microsoft (MSFT, Financials) currently control over 70% of the generative artificial intelligence market, which Musk finds to be anti-competitive.

Originally starting legal action against OpenAI, which he co-founded in 2015 with Sam Altman, Ilya Sutskever, and Greg Brockman earlier this year, Musk said that the company placed profit over human well-being. The action was rejected but resurrected in August based on what Musk claimed to be original complaint’s lack of effectiveness.

Last month Musk expanded the lawsuit to include Microsoft executive Dee Templeton, former OpenAI employee Reid Hoffman, and co-founder of Microsoft LinkedIn.

According to Musk’s lawsuit, OpenAI has veered from its original non-profit mission. Microsoft has committed roughly $14 billion to OpenAI, including support for its most recent funding campaign, which valued the company at $157 billion. Having raised $6 billion, Musk’s own artificial intelligence company, xAI, has a value of $50 billion.

Apart from his AI initiatives, Musk also pays great attention to Tesla’s global expansion. To meet the growing demand for electric cars, Tesla has said more manufacturing locations in Asia and Europe. Although global market conditions have affected Tesla’s shares, Musk is still hopeful about the company’s future evolution.

The legal conflict reveals the growing conflicts among important players in the artificial intelligence industry vying for dominance in the fast-growing generative AI business.
